These Terms of Service ("Terms") govern your access to and use of the Kapdamart website, including browsing, creating an account, placing orders, purchasing customized products, and submitting bulk-order enquiries (the "Site" and the "Services"). The Site is operated by Kapdamart ("Kapdamart", "we", "us", or "our").

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site. These Terms are subject to applicable Indian laws, including consumer protection and e-commerce laws. Nothing in these Terms is intended to exclude or limit any right that cannot legally be excluded or limited.

You must be at least 18 years old and legally capable of entering into a binding contract under applicable law to place an order or create an account. If you use the Site on behalf of a business or organization, you confirm that you are authorized to act on its behalf.

You are responsible for providing accurate, complete, and up-to-date information when creating or using an account. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, to the extent permitted by law. Notify us promptly at care@kapdamart.com if you become aware of unauthorized access or suspected misuse.

We may suspend or restrict access where reasonably necessary to protect the Site, users, or our business, investigate suspected fraud or misuse, or comply with law. We will act in accordance with applicable law.

We make reasonable efforts to display product descriptions, images, colours, sizes, and other details accurately. Actual colours or appearance may vary depending on device displays, lighting, materials, printing processes, and production variations. Product images may be illustrative unless expressly stated otherwise.

Products are subject to availability. We may update, limit, suspend, or discontinue products or features. If we cannot fulfil an order that has already been accepted, we will inform you and arrange an appropriate remedy, including a refund where applicable.

Prices are displayed in Indian Rupees (INR), unless stated otherwise. Applicable taxes, shipping charges, discounts, and other charges will be shown during checkout or communicated in a bulk-order quotation, as applicable. The tax-inclusive or tax-exclusive status of a displayed price will be indicated where required.

We may change prices or promotional offers from time to time. A price change will not affect an order already confirmed, except where an obvious pricing or technical error has occurred. If we identify a material error in an order price before dispatch, we will contact you to confirm whether you wish to proceed at the corrected price or cancel for a refund.

You agree to provide accurate billing and payment information. Orders are subject to successful payment authorization and confirmation. Payments may be processed by third-party payment service providers.

Placing an order is an offer to purchase the selected products. An order is not accepted until we confirm it through an order confirmation or otherwise communicate acceptance. We may contact you to verify order details, delivery information, customization instructions, or payment status.

We may refuse, cancel, or limit an order where reasonably necessary, including in cases of suspected fraud, inaccurate information, payment failure, product unavailability, pricing or listing errors, or inability to fulfil the order. If payment has already been received for an order we cancel, we will arrange a refund of the amount paid, subject to applicable law.

If you wish to modify or cancel an order, contact us as soon as possible at care@kapdamart.com. Whether a regular order can be changed or cancelled depends on its processing, packing, and dispatch status. Regular orders may be cancelled within the permitted cancellation timeframe, subject to processing status.

Customized or personalized orders cannot be cancelled once production has started, because materials or production work may already have been committed. Any cancellation request received before production begins will be reviewed on a case-by-case basis.

Nothing in this section limits any cancellation, refund, or other right that applies under mandatory law.

For ready-to-ship products, dispatch is generally within 1–2 business days after successful payment confirmation. Regular customized products may require an additional 1–2 business days of processing before dispatch. Customized bulk orders exceeding 200 pieces may require approximately 7 business days for production, preparation, and quality checks before dispatch; actual timelines may vary depending on quantity, design, and complexity.

After dispatch, estimated delivery is generally 3–5 business days for metro cities, 5–7 business days for Tier 2/3 cities and towns, and up to 10 business days for remote locations. These are estimates, not guarantees, and may vary due to courier operations, weather, holidays, location, or other circumstances.

Risk and responsibility for the products pass in accordance with applicable law and the delivery terms applicable to your order. Nothing in these Terms affects statutory consumer rights.

Eligible regular, non-customized products may be requested for return within 7 days of delivery, subject to the conditions and exclusions in our Returns, Refunds and Replacement Policy. Products must generally be unused, unwashed, unworn, with original tags, labels, accessories, and packaging intact, and are subject to inspection.

Customized and personalized products are generally non-returnable and non-exchangeable, except where the product is delivered damaged, defective, or materially different from what was ordered. For such an issue, contact us within 48 hours of delivery with your Order ID, clear product photographs, packaging and shipping-label photographs, and a description of the issue.

For an approved return or refund, refunds are generally processed to the original payment method within 5–7 business days after quality-check approval. Bank or payment-provider posting times may vary. Please review the Returns, Refunds and Replacement Policy for the complete process and conditions.

When you submit photographs, artwork, text, logos, graphics, or other material for a customized product, you grant Kapdamart a limited, non-exclusive, royalty-free permission to use, reproduce, adapt as technically necessary, and share that material with relevant production and fulfilment partners solely to prepare, manufacture, quality-check, deliver, and support your order.

You confirm that you own or have obtained all rights, licences, permissions, and consents needed to submit and use the content, including any required permissions from people appearing in photographs. You must not submit content that infringes intellectual property, privacy, publicity, or other rights, or that is unlawful.

You remain responsible for the content and customization instructions you provide. Please carefully review spelling, names, sizes, artwork, colours, and other details before approving a design or production preview. We are not responsible for errors in information or artwork supplied or approved by you, subject to applicable law.

We may refuse content that we reasonably believe is unlawful, infringing, abusive, discriminatory, or otherwise unsuitable for production.

Unless otherwise stated, the Site and its content, including Kapdamart branding, logos, text, graphics, layouts, photographs, product descriptions, and website design, are owned by or licensed to Kapdamart and are protected by applicable intellectual property laws.

You may access and use the Site for personal or legitimate business purchasing purposes. You must not copy, reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Site content without our prior written permission, except where permitted by law.

Any third-party trademarks, logos, or designs remain the property of their respective owners.

You agree not to:

• Use the Site for any unlawful, fraudulent, misleading, or unauthorized purpose.
• Attempt to interfere with the Site's security, availability, or proper operation.
• Upload malicious code, viruses, or harmful files.
• Access accounts, systems, or data without authorization.
• Submit content that infringes another person's rights or violates applicable law.
• Use automated means to scrape, copy, or extract Site content without permission.

The Site may include links to or integrations with third-party websites and services, including payment gateways, authentication providers, analytics services, and courier platforms. These services are operated independently and may be governed by their own terms and privacy policies. We are not responsible for third-party services to the extent permitted by law.

We take reasonable steps to keep the Site information accurate and the Services available. However, the Site may occasionally be unavailable, delayed, or affected by technical issues, maintenance, network interruptions, or events beyond our reasonable control.

To the extent permitted by applicable law, the Site and its content are provided on an 'as available' basis. We do not guarantee uninterrupted or error-free operation. Nothing in these Terms excludes warranties or protections that cannot legally be excluded under Indian law.

To the extent permitted by applicable law, Kapdamart will not be liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profits, revenue, data, or business opportunity arising from use of the Site or Services.

Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, gross negligence where exclusion is not permitted, death or personal injury where exclusion is prohibited, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited or excluded.

Where liability may lawfully be limited, our liability will be assessed in light of the circumstances, the nature of the claim, and applicable law.

To the extent permitted by law, you agree to be responsible for losses, claims, and reasonable costs arising from your unlawful use of the Site, your breach of these Terms, or content you submit that infringes another person's rights. This does not apply to the extent a claim results from Kapdamart's own breach, negligence, or unlawful conduct.

We will not be responsible for delay or failure to perform to the extent caused by events beyond our reasonable control, such as natural disasters, severe weather, public emergencies, strikes, transport disruptions, government restrictions, or widespread failures of communications or infrastructure. We will take reasonable steps to minimize the impact and keep affected customers informed where practicable.

Our collection and use of personal information is described in our Privacy Policy. By using the Site, you acknowledge that you have been provided access to that Policy. Please review it to understand how we handle personal information.

We may revise these Terms from time to time to reflect changes in our services, business practices, or applicable law. The updated version will be published on the Site with a revised 'Last Updated' date. Where required by law, we will provide notice or obtain consent. Your continued use of the Site after revised Terms become effective constitutes acceptance to the extent permitted by law.

These Terms are governed by the laws of India. The parties will first attempt to resolve disputes through good-faith communication by contacting care@kapdamart.com.

Subject to mandatory consumer rights and the jurisdiction of consumer commissions or other forums established by law, courts and forums having competent jurisdiction in Ghaziabad, Uttar Pradesh, India, will have jurisdiction over disputes arising from these Terms. Nothing in this clause deprives a consumer of a forum or remedy available under applicable law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent possible. These Terms, together with the policies expressly incorporated by reference, form the agreement governing your use of the Site, subject to applicable law.
